2006 Land Use Update
|
Abstract: A year later, the U.S. Supreme Court's landmark land use decision in Kelo continues to reverberate in courtrooms, legislatures and in legal practice. After a surge of public interest and pressure, state legislatures have been busy proposing and adopting legislation placing more restrictions on the ability of the state and developers to acquire and use private property. What has traditionally been a matter of municipal ordinance is rapidly being displaced by substantive federal and state regulation. The effect is to leave traditional notions of land use law and planning in a state of disarray. In this program, three of the nation's leading land use practitioners - representing property owners, developers, and municipalities - will discuss continuing developments in land use.
